Blast from the Past...
Most of you know, or may not know, or actually may not even care that I grew up in Oklahoma City. We did not come to Texas until I was 16 years old.
Every so often a tune comes into my head from when I was a kid, and 40 years later I can remember every word of the B.C. Clark Jewelers Anniversary Sale Jingle.
Why? I really don't know except that there probably was not a single Christmas season since I was very, very young that this song did not play on the television many times a day.
That was back in the time when there were only 3 real TV channels in OK City: 4 was NBC, 5 was ABC, and 9 was CBS. 13 (PBS) was nearly always there, but we didn't watch it that much.
So, this tune is running endlessly through my brain this evening which gives me the thought to google BC Clark Jewelers in OKC. It comes up on Wikipedia as being known for the famous jingle that was written for them in 1956. Since I am brought into the world in September 1957, I hear this song every year almost from the day I am born.

A 21 year old American student is, for some reason, protesting the Israeli use of force against an Islamic flotilla that was aggressively vying for a confrontation with the Israeli government.
The Obama administration is making a huge mistake siding against Israel.
I don't think that Israel has as high a tolerance of hippies as the United States.

And did you know...
That Obama has sent Holder (Eric Holder, US Attorney General) to start collecting information for civil suits and criminal prosecutions against BP?
That may be necessary later, but perhaps it would be best if he (Obama) just got out of the way and let this leak get plugged before they start hauling people into federal court and in front of Congress. Statutes of Limitations are long, and there will be plenty of time to play the blame game. It seems to me that getting this thing stopped should be the priority for BP and the Obama Regime.

As most of you know, I am not a big Al Gore fan, but I hate to see people throw away 40 years of marriage, especially after what they have been through together. You would think that, after some amount of time, you could feel secure in that relationship. I guess I don't get it. He is 62 and she is 61. Perhaps these days, that is young enough to start over again.

That official Whitehouse physicist Stephen Chu ordered the topkill stopped on the bleeding oil well in the gulf. Suddenly, he became fearful that the pressure from the heavy mud might cause another problem somewhere else.

Those Clintons are at it again...
I always get a kick out of the involvement of that former President Clinton and the current Secretary of State, his erstwhile wife.
First of all, Bill is taking that fall for Obama on the Sestak bribery scandal from the Whitehouse. They are saying that Bill Clinton offered Sestak an unpaid position on a Presidential advisory council if he would not run in the primary.
HUH?
What kind of a bribe is that? Why in the world would they think that a guy would pass up a solid chance at a Senate seat for an unpaid position on some presidential council? Talk about backtracking to cover your tracks. And of course, Slick Willy is more than happy to cover for the Obama Whitehouse since his wife's job is on the line.
Then we have Mrs. Clinton, your Secretary of State holding the Brazilian system of taxation up as an example of how we should be. What was her statement? Oh yeah, "the rich are not paying enough in taxes." (I guess like they do in Brazil.)
Hillary, taxes are monies that are actually paid to the federal government, just in case you weren't clear on that. How much money have you hidden in your foundations? Let's see, there is $10 million in the Bill Clinton Memorial Library and Massage Parlor. That's $10 million tax dollars that you deprived your government of. That's $10 million they are going to have to get from somewhere else. But wait, there's more: Hillary had a secret foundation that they had stashed $5 million in prior to 2008. She decided that she probably should disclose that foundation during her run for the presidency in 2008. By the way, aren't those foundations supposed to pay money to support the purpose of the foundation? I hear that Hillary's foundation paid nothing last year in gifts or endowments or whatever you call contributions from a "foundation".
And finally, leading up to the person who holds the leashes of Bill and Hillary Clinton, Obama has accused BP of not being transparent in disclosing all of the ramifications of their efforts to stop the oil leak. Nice, since the Obama administration is about as transparent as a block of granite when wielding their strongarm Chicago political tactics, such as offering jobs to Congressmen who indicate a desire to unseat an incumbent liberal democrat Senator.

Need a new health magazine to subscribe to...
I guess I'm done with MensHealth Magazine. I'm not going to cancel my subscription, but when this runs out I won't be renewing. I have subscribed to that magazine for over 10 years now, but in the last few months it has become a liberal propaganda rag for Obama policies.
They have written articles in favor of government controlled health care in this country and turned their back on the possibility of removing state roadblocks to more interstate competition among health insurers. Last month, I read a long article touting the virtues on the French health care system.
But this month, in the editors preface page, he is positively giddy over the fact that he proposed a tax on sugary sweet foods under the guise of helping America regulate their diets.
Have so many Americans lost their minds that they want the government trampling on our freedoms to make choices...any choices?
Why not pass legislation banning sugar and high fructose corn syrup in manufactured foods?
Are we going to have the kitchen police now? Are they going to march four abreast into your kitchen to check your cannisters and cupboards for sugar or syrup?
Where does this madness stop?
Have Americans gotten so simple and dull witted that we need our government in Washington legislating what we eat?
And what about the impact to the sugar industry and the corn growers? Is Obama willing to add even more people to his unemployment casualty roll in favor of more regulation and tax?

Second Day as a Defense Attorney
I am learning about making jail visits. (It's amazing that in 27 years as a prosecutor, I don't have alot of experience visiting people in jail. Well, maybe no so amazing.)
I got my first court appointment today (and that's all I'm saying about that).
I am enjoying the new work and the new point of view, but mostly I am enjoying the time I have with Cindy.

Gulf Oil Spill Crisis
Okay, boys and girls:
Is there anyone besides me who sees the explosion of the BP oil rig in the Gulf as the result of a plot by environmental extremists?
It's unbelievable the way those people have used this as a cry to essentially stop oil production in the United States. Even Arnold Schwartzenager has reversed his stance on offshore drilling and now he is totally against it.
Has anyone heard what the cause of the explosion was? I haven't heard a word about the cause. Apparently, it was all very mysterious.
And I would not put it past those environmentalists to pull a stunt like this. Look at the way they are celebrating a disaster that killed 11 people. I have never seen a group that loves an accident or a disaster more than the environmental extremists.

New office update
I picked up my busiess cards and several items of office furniture today. I ordered my desk and it will be here soon.
Topless in Maine...Why?
I stumbled across this video of women marching topless in Maine. Apparently they are protesting that men get to walk about without shirts, so they should, too. The report makes it clear that it is perfectly legal for women to go out in public with their breasts uncovered, but the protesters want it to be "socially acceptable" as well.
How does protesting make that happen. As near as I can tell, the men of Maine are all for making it socially acceptable as they were taking numerous photos of the topless women. It was the women who most opposed the topless women. "Nobody wants to see that" (or something to that effect) was said by one women.
How do you protest something that is already legal? How does protesting make something socially acceptable? Is their protest going to do away with 2000 years of socially programmed mores all of a sudden?
What gets into some people, really? Do they just not have enough to do in Maine? I hear they have some biting flies in the Maine summer that can make you pretty miserable. If so, wouldn't you want to cover up as much as possible?

The June Bugs worship the Light
Here is a repost of last summer's photos of the june bugs gathering for worship service to pray to the great light (bug light, that is). Other bugs fly into it and die, but the june bugs just surround it and hang out. It's great because they are not in the garage bothering me. So there you go. The same phenomenon has started already this year. I have to put the light in the driveway to keep the june bugs out of the garage.

And, I hear on WBAP this morning that there was an incident on the last cruise of the Carnival Ecstacy, a ship we have cruised on twice. Apparently, there was a buoy that had broken free and was floating free in the Gulf. The Ecstacy happened upon it and had to make a hard right turn to avoid a collision. The turn was hard enough to knock things off of shelves and make several passenger actually fall down. Luckily, no one was hurt badly enough to require medical attention. We have been on so many cruises, and we have never had a bad one. I love cruising.

A pair of ducks have taken up residence in my front yard. I suspect they have a nest somewhere nearby because they don't seem inclined to stray too far from our yard. I enjoy watching them.
Navy Seal cleared of abuse charge.
Do you all remember this scandal from last year where the left was trying to discredit our servicemen and elevate the terrorists to some type of martyrdom in the United States? Guess what. The first of the accused Navy Seals has been tried and found innocent of "abusing" a prisoner, as in, it didn't happen. Perhaps the turning point in the case is that the prisoner had no injuries. Perhaps it was simply because the whole thing was trumped up by Obama and his left wing cronies to tear down the military and elevate middle eastern terrorists in the eyes of the American people.
Let me just recall...the main stream media couldn't carry the story of the accusations of the Seals enough, but have you heard a word about the NOT GUILTY verdict?
The left it trying to scam us at every turn, and so many of you are swallowing the BS.

Noticed on another blog...
I was just reading the blog called Liberally Lean, which is operated by a friend of mine in Decatur. I see that he mentioned that Paige and I were leaving the DA's Office at the end of the month. I thought it was nice that he didn't hack on us given our historic differences in views of the need for law enforcement. It was never personal and I always enjoyed visiting with BG, especially when we weren't necessarily talking about any of his clients.
The comments on the blog are particularly amusing. I want to thank whoever it was that said Wise County was losing "two awesome prosecutors". We tried very hard, and I felt like we brought alot to the table. It is nice to hear the odd compliment every so often.
I will tell you that the awesome people in the office are the administrative staff for all the work they do to keep that place afloat (Tessa, hang in there, it will be all right). They have their hands full. I hope Greg can find some good replacements for us.
It was a good job, and for the most part, a fun and exciting job. There is still alot of hard work to do, but like I always say: it was there when I showed up and it will be there when I'm gone.
What matters is that I gave the job my full attention and effort. I will do the same for my new career and for my clients.

Leaving Wise County
I have told everyong that I can about this. I am leaving my employment as an Assistant DA in Wise County and joining private law practice with my wife. I have been prosecuting for 27 years, and I am excited about the new opportunity. I will take cases in Denton County and Wise County to start. We may expand to other counties if the work demands it and our time constraints permit.
I actually thought some of the attorneys might get together and ring the courthouse chimes, but I guess they couldn't get that done.

Okay: Very Cool vs. Very Uncool
VERY COOL:
This story about a whale escorting a paddle surfer who was doing the journey to raise money for breast cancer. Apparently, the whale simply swam alongside her board and did not bother her. The article says that these kinds of encounters with these kinds of whales are very rare. The woman doing the journey took it as a sign from God. I agree, and we need more signs from God these days because evil is spreading among us at a rapid rate.

The new health care law will apparently require (aka force) middle aged people who are not married to purchase insurance that includes pediatric care. I know why they do that: the same reason we all pay school taxes for public schools even though we may not have kids in the schools. However, there is absolutely no reason to compound that wrong, socialistic, "spread the wealth" type of thinking.

This just goes to show how irresponsible op-ed writers can be. I guess this guy didn't see the earlier video of the crazy woman attacking Karl Rove. There are little pockets of crazy people all over the place, including what the press calls "terrorist cells". I see the desire to tie conservatives to the crazies, like the Republic of Texas people and those of that ilk, but people writing these columns need to resist the urge to engage in this type of slander, just as conservative columnists need to resist the same urge.
I am always more interested in facts than cliches, platitudes, and rhetoric. Unfortunately, the average person has to be motivated to dig for the facts since all we get are cliches, platitudes, and rhetoric from the mainstream press, which includes sound bytes from Obama.
This is why I am reading the Health Insurance Bill. As much as I listen, no one actually talks about the languange of the bill. They all seem to want to discuss absurd extremes.

Jury Duty Today
I am in Denton today. I got a summons for jury duty that I had to report for. They summoned 290 people, and Judge Collier said that they only needed 131 of us for panels. So I figure my odds are pretty good, huh. Not so...My name was drawn for the very first panel in the 16th District Court with Judge Rivera-Worley. What incredible luck. Judge Collier did inform us that the case was a felony trial. I guess Wise County will have to get by without me today. I don't anticipate lasting long on the panel, but who knows. At any rate, I suspect I will stay away from the casino today with this kind of luck going for me. I did get to see some old friends that I have missed and that was very nice.

Also known as H.R. 3590 which was passed and signed by Obama this week.
I hear that it's great and that it's awful. I really don't know.
I have my skepticism about an effort to regulate a private business that takes over 900 pages.
I am determined to read this thing to figure out for myself if this is movement in the right direction or a colossal mistake.
I fear the tax repercussions of this law. In Canada and the UK, the citizens pay high percentages of their incomes to taxes to support a socialized medicine system. Still, many of them flee to the United States for superior medical care that their own country can't seem to provide.

Vernal Equinox....2010
It is snowing here on the first day of spring 2010. Are you kidding me? So later, when someone asks when was the latest snow in North Texas? Why it was in March of 2010. It snowed on the first day of Spring that year (you bunch of old codgers).
I heard another global warming commercial about some thing that a guy was selling that would absorb more of the carbon dioxide being released into the atmosphere. I only think of this because it is snowing tonight. The empirical evidence of personal experience would suggest that we are not getting warmer.
What's so bad about carbon dioxide? Isn't that the by-product of every breathe we take? Don't all plants need carbon dioxide to live? If there is more carbon dioxide, is that not good for all vegetation on earth? And if there is more vegetation, doesn't the rest of the food chain also thrive?
Moreover, if there is more carbon dioxide, then we can stop talking to our plants to help them grow better. You do realize your plants can't hear you, right? Talking to them merely releases extra carbon dioxide in the direction of the specific plant.
And does anyone see the funny coincidence in the fact that Toyota has been getting all of this bad publicity in the mainstream media after the federal government under B. Hussein Obama took over General Motors and Chrysler? Does no one else see that, really? It's as plain as day to me, but then I simply do not trust the people that have the Whitehouse right now.
I was listening to the radio and the guy asked, "How many of you believe that President Bush was socio-economic liberal?"
I had to raise my hand, but I kept the other one on the wheel. See: "Stimulus Plans"...very liberal indeed.
FM 96.7 has switched formats and become the FM version of WBAP. I listen to WBAP every morning, but I am glad they went FM. There is a stretch of 380 surrounded by power lines that seem to interfere with the AM signal. Now that is a problem no more.
Speaking of FM, how many of you remember that movie from the '70's? Great movie. I went looking for a copy of it on DVD, and it is not to be found. Some guy on Amazon had a used one, but he wanted a pile of money for it, too. Not that motivated. I saw it on TV the other night. Sometimes VH1 shows some good old movies like that.
PMAC has been bringing "West Wing" to work. Remember that show where Martin Sheen played President Bartlett. You have to overlook the liberal politics and shenanigans they pull, but if you can do that, the show is very entertaining, well written and well acted.
I watched "Under Siege 2: Dark Territory" last night. I don't always like Steven Segal in every movie, but the first "Under Siege" with Segal and Tommy Lee Jones was definitely his best. I couldn't imaging "2" being any good at all. It wasn't as good as the first one, but it was good. I was very entertained.
One of my loyal commentors on this blog (and the three of you know who you are) asked me about the novel. There is not a day that goes by that I don't think about it. I may be a little frozen on which way to take the concluding chapters, but I can deal with that. The problem is that work has gottes so stressful, and I have so many important things that have to be done around the house, I have not actually had time to work on it, but that is about to change. I have begun dealing with the stress, and I am having some success at putting that behind me. Solutions come around near every turn, now.

On a nice sunny day...
We had a big DWI trial end today. Greg and Lindy tried the case together. I really don't think the defendant expected to be convicted. Well, he did get convicted and the jury then sentenced him to 8 years in the penitentiary with a $5000 fine. Very good job by Greg and Lindy. This is good because these guys probably present more of an every day danger to all of us than anyone.
It really was a beautiful day today. I am so ready for spring and summer.
I believe I would like to be Board Certified in Criminal Law.
I also want a motorcycle.
Today's editorial was a bit harsh, but just a bit. Some of the mudslinging got out of hand, with the exception of myself, of course. The opinion does fire a shot and those hiding behind the cloak of anonymity while making all kinds of heavy-handed statements. However, I did not write anonymously. My letters to the paper bore my name and I used my name to comment online in the editorial page, too. I may be angry, but you know who I am.
Finally, and sadly for me, I found out today that Cristie Fuqua, the lady who has been the District Clerk for Wise County lost her bid for reelection. They tell me that she has been there for 20 years. That is amazing. I have gotten to know her and her staff over the last 3 years, and it is a wonderful office. Circumstances in her life kept her from campaigning as much as she would have liked. I certainly hope the rest of the staff remains; they are a good crew. I will miss Cristie, she is a wonderful person, on top of everything else.

It's all over...
At last check at this hour with about 97% of the precincts reporting, it looks like Denton County is stuck with Paul Johnson for a District Attorney for at least 4 more years. He has over 61% of the votes tallied. The officials will be in the morning, but it won't even be close.
Too bad.
Also, it looks like Judge Collier has been unseated by Steve Burgess and there will not be a runoff.
There will be a runoff for the Juvenile Court bench between Kimberly McCary and Chance Oliver.
Also, there will be a runoff for the Probate Court position between Robert Ramirez and Bonnie Roberson.

My Letter to the Editor printed today. One of my better efforts.
In defense of Bowen
I received Paul Johnson’s flier in the mail today urging me to re-elect him as district attorney.
I am astounded at the hypocrisy of the statements against Brent [Bowen], but apparently Johnson’s hypocrisy knows no bounds. He attacks Brent, saying that Brent defended those accused of crimes.
Let me remind you, the voters — and you, Paul Johnson — that Johnson fired 25 career prosecutors (including me) and replaced them with a plethora of defense attorneys, namely Tom Whitlock, Hardy Burke, Jamie Beck, Cary Piel and Susan Piel.
People of Denton County, in case you didn’t know it, your district attorney has always been in the pocket of the local defense bar. That is why your crime rates have risen. If Johnson is pointing a finger at Brent for being a defense attorney, he should point at his own staff first.

I have attended several political forums and received mailers from Paul Johnson. I must say his ranting and raving about how many hundreds of felony cases he has tried makes me want to add stilts to my already chin deep waders. I guess he doesn't remember why the previous administration let him go. It was because he was not trying cases and pleading them too cheap. His nickname was "2D Paul" which means he gave better plea bargains that you could ever get a Canton's First Monday. But that is not all that makes you want to ask: “How deep is the water momma?” He proclaims to have collected $3,359,600.00 in bond forfeitures since taking office, an 80% increase. I made and open records request from the auditor's office and guess what! Put your waders on because he has only collected $2,072,478.49 a negative 22.5% from what the previous administration collected. OH! And, about trying cases; he promised to try 20 cases a year when he took office- never happened. He stated at one forum that he almost tried one case. Yes, that right, ALMOST, but never did. You won’t need waders with Brent Bowen. He doesn't inflate or make promises he can't keep.

It's always so hard to go back to work after a long break, and I had a great Christmas break this year.
To answer an earlier commenter, I want to at least get a conclusion down on paper.
I got my email dilemna figured out all by myself. I had to go in and redelegate my email server from verizon.net to yahoo.verizon.net. I can't believe there was no instruction on that in the changeover, but the repairs are done.
I still love my new Iphone.

Verizon/Yahoo merger.
Apparently, Verizon and Yahoo have done some kind of a merger that changes the verizon home page format to look mostly like the Yahoo home page.
I am sure that this is probably okay, but it appear to have played havoc with my Outlook Express server for my home email account.
It looks like I will be on the phone with the Verizon tech support desk tomorrow.
